Health Board Seeks Legal Help with Flavored Tobacco Violations

The Board of Health wants to go after a retailer who members say continues to sell flavored tobacco products to young people despite the new town bylaw prohibiting it. The board is seeking to use town counsel to go after a seller they described as defiant.
"This particular establishment is catering to kids," Health Board Vice Chairman Peter DeTerra told selectmen March 16. Selectmen approved $1,000 in legal costs to start the process, using Town Counsel Thomas Crotty.
The Board of Health passed a bylaw last year prohibiting the sale of flavored tobacco products in . DeTerra said this one retailer has been defiant and has been selling the flavored tobacco products near the middle school.
Health board member Barbara Acksen said the problems with this retailer have been ongoing. She said the store owner came to a health board meeting to object to the new regulations.
The health board didn't say who the retailer is. On Tuesday, Health Agent Patricia Fowle said they would rather not name the store by name. Fowle said there is already a court date for the dispute.
Fowle called it a "new regulation and enforcement has to be absolutely correct." Enditem
