Kenya: Court Halts Cigarette Brand Ban By Ministr

The High Court has suspended the ban imposed by the Ministry of Health over circulation of British American Tobacco's Dunhill Switch cigarette brand.

High Court Judge Weldon Korir said it is apparent that BAT will suffer loss if the director of Medical Services decision is not halted. Korir said the ministry was accorded opportunity by the court to respond to BAT's application for a stay order but did not respond.

Through lawyer Nazima Malik, BAT said the ministry threatened to take "adverse action" against it if it did not comply with the ban. The NSE-listed cigarette maker claimed it is not running a promotion as alleged and has not contravened provisions of sections 23 and 25 of the Tobacco Control Act. Enditem
