Patent Case Set for Further Proceedings

Star Scientific said earlier this week that its patent infringement lawsuit against RJ Reynolds Tobacco Co had been remanded for further proceedings. It said a three judge panel of the US Court of Appeals for the Federal Circuit had ruled unanimously that the lower court's ruling, that Star Scientific had engaged in inequitable conduct, was 'clearly erroneous', and that it had reversed the district court's grant of summary judgment holding Star's patents indefinite.
