Tobacco Reporter Magazine Content: Date set for Star Patents Appeal Arguments Source from: tr.itsmyiq.com Jan 24, 2008 01/25/2008 Oral argument on the appeal brought by Star Scientific in its patent infringement lawsuit against R. J. Reynolds Tobacco has been set for March 7 by the US Court of Appeals for the Federal Circuit, Star says in a note posted on its website yesterday.
The case concerns Star patents describing a method of treating tobacco substantially to prevent the formation of tobacco-specific nitrosamines.
Star is appealing against three rulings by the U.S. District Court of Maryland that were issued in January and in June, 2007.
'A three-judge panel will review the parties' written briefs and hear oral arguments, and will issue its ruling on the appeal thereafter,' says Star.
'The company is pleased that the Federal Circuit Court has moved rapidly in scheduling oral argument, and continues to believe that it ultimately will be successful in the judicial process.' Enditem
